Review of an environmental expert examination

When it is used

The service is needed where expert substantiation is required for the circumstances of an environmental dispute: contamination, the source of an impact, a causal link, the extent of harm or shortcomings in a previous examination.

What is analysed

  • documents, records, photographs, video, claims and case materials;
  • the location of the object, possible sources of impact and the sequence of events;
  • laboratory test reports and the correctness of sampling;
  • consistency of the conclusions with the source data and methods;
  • possible restoration and land reclamation measures.

Result

The work results in an expert opinion, review or written specialist position with conclusions that may be used in negotiations, a claim or court proceedings.

Important: if laboratory tests are required, their cost and timeframe are usually calculated separately according to the parameters, number of samples and object.

A review checks whether the conclusions of an environmental expert examination follow from the objects, reports and methods used. Disagreement with the result is not in itself proof of an error.

Subject of examination

  • The complete text of the opinion and appendices
  • The sampling plan and laboratory test reports
  • Causation, extent of the impact and cost calculations

Sample questions for the expert

  • Is the source data suitable for the questions posed?
  • Are the background samples and samples under examination comparable?
  • Is the progression from individual measurements to conclusions about the source and extent justified?
  • Do the measures included in the calculation correspond to the changes established?

The final questions are formulated according to the objects and circumstances of the particular task.

What to prepare

  • The complete opinion with appendices and photographic tables
  • The court's or Customer's questions and the materials provided to the expert
  • Sampling records, laboratory test reports and maps of sampling locations
  • A party's objections and documents that may not have been considered

How the examination is conducted

The analysis follows the sequence: question, object, source data, method, result and conclusion. Comments refer to specific pages and explain how a shortcoming affects the validity of the answer.

Scope and limitations

A review does not replace the examination of new samples and does not automatically invalidate an opinion. If required materials are missing, that limitation is stated rather than filled with an assumption.

What the deliverable records

A reasoned analysis is prepared, distinguishing material shortcomings, disputed assumptions and circumstances requiring further examination.
