How to substantiate environmental damage

The affected object, cause, extent, laboratory data, calculations and restoration measures.

Environmental damage is substantiated through the fact of the impact, the condition of the object, applicable calculation methods and the scope of restoration measures.

A well-supported position requires a distinction between factual data, laboratory parameters, calculations and conclusions about the causes of harm.

If the dispute is already before a court, the questions for the expert must be formulated so that they are verifiable and relate to the matters to be proved.

What to prepare for your enquiry

  • a description of the situation and the dates of events;
  • photographs, video, records and correspondence;
  • documents relating to the object or land parcel;
  • laboratory test reports, if already available;
  • court documents, if the dispute is already being heard.

From contamination to calculating harm

The presence of a contaminant does not in itself determine the amount of environmental harm. Calculations require identification of the affected object, the parameters of the disturbance and the applicability of the chosen approach to the particular situation. The extent of the area and the concentrations must be based on reproducible data, not arbitrarily chosen boundaries.

Which source materials to check

  • The sampling plan and record, sample identification and laboratory test reports.
  • Information on the area, depth or volume of the environmental medium examined.
  • The basis for background values and the comparability of sampling locations.
  • Documents on economic activity and possible alternative sources.

Actual measurements, adopted assumptions and regulatory grounds are identified separately in the calculations. If the initial data cannot establish the spread of contamination, calculating over a larger area does not turn an assumption into a proven fact.

Technically justified restoration measures also require a separate assessment. Their scope, cost and connection with the identified disturbance must be traceable through the examination materials.
